NEW YORK (AP) — U. S. health officials are warning Pfizer and its competitors to be cautious about selling Viagra or its rival Cialis — a drug often prescribed for erectile dysfunction — to potential buyers.
Viagra, a popular over-the-counter drug for men suffering from impotence, has been in the market for a few years. But when it comes to erectile dysfunction, its maker seems to be doing little or nothing. Last month, Pfizer Inc. said that the drug's maker would be required to pay $4.3 billion to settle lawsuits filed against it for misleading and deceptive marketing.
The suit, filed in New York state on Friday in U. District Court in Manhattan, states that Pfizer, which makes the erectile dysfunction drug, "did not promote the product or in any way promoted its product" in any manner. And even if it did, Pfizer says it "will continue to maintain that information regarding the product is incomplete or inaccurate."
The suit, filed in the Eastern District of New York, is part of a larger investigation by U. Immigration and Customs Enforcement's (ICE) Homeland Security Investigations (HSI), the U. Food and Drug Administration (FDA), the U. Postal Service and the Centers for Medicare and Medicaid Services (CMS) into the conduct of illegal and unfair trade practices in the United States. The complaint was filed by former U. Attorney Michael Avorn in Manhattan last month.
Under New York law, Pfizer's drugmaker can be required to prove that it was "likely" to promote the drug. Under the law, however, the company can also show that Pfizer knew of the existence of the drug before the lawsuit was filed and that its marketing practices were deceptive.
Pfizer said the lawsuit is not an example of a "co-promotion" or "off-label" practice, but rather a warning against the drug's marketing practices that the company must prove to the jury that Pfizer engaged in "fraudulent and deceptive conduct."
But Pfizer's lawsuit, filed in New York state in U. District Court, is the first to be brought against Pfizer in the United States. It alleges that on Nov. 18, 2000, Pfizer promoted Viagra to male patients by claiming that it was "likely" to treat the condition. When the drug was introduced, it was tested by the Food and Drug Administration, but did not appear to be approved for use in men.
The suit alleges that Pfizer "misrepresented to patients that Viagra could be used for the treatment of erectile dysfunction or to treat other conditions."
The complaint also alleges that the drug was not approved for use in men by the FDA at the time it was introduced.
The suit says Pfizer's marketing practices were deceptive. Under the law, the company must prove that Pfizer knew of the existence of the drug before it promoted it. The company must also prove that Pfizer's marketing practices were not deceptive. "Pfizer acted fraudulently by marketing the drug without actually promoting the drug, and the alleged false representations and false representation claims were the basis for the complaint," the suit states.
The lawsuit is part of a wider investigation by the FDA into the conduct of illegal and unfair trade practices in the United States.
In January, the FDA issued a warning to Pfizer on a drug called Levitra, which is used for erectile dysfunction. The drug is not approved for use in men. In the lawsuit, Pfizer says it has not been shown to contain enough of the active ingredient to make the drug effective enough for the treatment of erectile dysfunction.
Pfizer's lawsuit is the second to be brought against Pfizer in the United States. Last month, it brought an effort to take on the case, this time by a U. Attorneys' Task Force from the U. District Court in Manhattan.
